Informal Probate
Most Estates in Colorado are administered informally. This means the Probate is not court supervised. The administration of the Estate is commenced by the filing of a petition and a request to have letters of personal representation entered. Once the Estate is created with an informal administration, the personal representative is issued letters by the court. These letters allow the personal representative to pay bills and taxes. The personal representative may also distribute Probate assets pursuant to the instructions in the Will or if the descendent died without a Will, assets will pass pursuant to Colorado’s law of intestate succession.
A Probate can take as little as 6 months for a simple estate or as long as several years. Most Informal Probates in Colorado are administered in 7-12 months. At the end the Estate is closed informally by filing a form with the court that states the personal representative has paid all debts and taxes and delivered the property to those entitled to receive it.
Please be reminded that Colorado law requires that descendants Will to be filed with the District Court within 10 days of death, even if there will be no Estate administration.
