Reducing Or Eliminating Estate Taxes
Depending on how much you own when you die, your Estate may have to pay Estate taxes before your assets can be distributed. Estate taxes are different from and in addition to probate expenses and final income taxes. Although some states have their own inheritance/death taxes, Colorado currently does not. Federal estate taxes are expensive and must be paid in cash within 9 months after you die. Since few estates have this kind of cash, assets often have to be liquidated. This forced liquidation may not allow the maximum value to be received.
Your Estate will have to pay federal Estate taxes if its net value (assets - debt) is more than the exempt amount set by Congress at the time. In 2009, the exempt amount of property is $3.5 million. In 2010 the Estate tax law is repealed. Starting in 2011, the exemption amount is $1 million.
The net value for your Estate tax purposes includes all of your assets less your debt. This includes your home, all real estate, business interest, bank accounts, investments, personal property, IRAs, retirement plans and death benefits from your life insurance or policies that you own.
You can reduce or eliminate your Estate taxes by using three basic strategies:
