Charitable Lead Trust
A “Trust” is created when a person (the “Settlor” or “Grantor”) transfers ownership of property or assets to a “Trustee” to be held in a new entity created by a legal document. The Trustee uses or invests the property or assets for the benefit of a third party the “Beneficiary” who was specified by the Grantor/Settlor when he or she made the Trust. There are numerous types of Trusts all with different goals. Some Trusts are “Revocable” where the Settlor can change or even revoke the Trust at any time during his or her life. Some Trusts are “Irrevocable” where the Settlor gives up all control over the Trust property or assets and the Trust does not end until the purpose or goal of the Trust has been met.
In most Revocable Trust, the Settlor retains some beneficiary interest in the Trust property or assets. In other words the Settlor gives up ownership in the property but retains the right to access principle and/or receive income that is generated by the Trust. Common types of Revocable Trusts are a Revocable Living Trust and Qualified Personal Residence Trust. Both are useful tools to avoid Estate taxes. In most Irrevocable Trusts, the Settlor does not retain any of the beneficial interests in the Trust property and assets. A common Irrevocable Trust includes an Irrevocable Life Insurance Trusts.
