Offshore Trusts - Doctor/Physician Asset Protection Trust
An asset protection Trust is a Trust utilized to protect assets from creditor attack. It is normally established in an offshore jurisdiction although the assets usually remain in the United States under the indirect control of the person establishing the Trust. The Trust is normally created so that the undistributed assets of the Trust are returned to the Settlor on termination of the Trust provided that there is no current risk of creditor attack. This allows the Settlor, upon the closure of their medical practice or business, to regain complete control over the formally protected assets.
