Does Joint Ownership Avoid Probate?
Formal Probate is a court supervised process of transferring the descendents interest to his or her beneficiaries. This means the Probate is court supervised. The administration of the Estate is commenced by the filing of a petition and a request to have letters of personal representation entered. Once the Estate is created, the personal representative is issued letters by the court. These letters allow the personal representative to inventory the assets and prepare an accounting. Once filed and approved, the personal representative can pay bills and taxes. The personal representative may also distribute Probate assets pursuant to the instruction in the Will or if the descendent died without a Will assets will pass pursuant to Colorado’s law of intestate succession.
A Formal Probate can take as little as 9 months or as long as several years. Most formal Probates in Colorado are administered in 12-18 months. At the end the Estate is closed by filing a form with the court that states their personal representative has paid all debts and taxes and delivered the property to those entitled to receive it.
Please be reminded that Colorado law requires that descendants Will to be filed with the District Court within 10 days of death, even if there will be no Estate administration.
