Avoiding Probate
An alternative to attempting to use joint ownership to avoid probate is to create a Living Trust. A Trust has grown increasingly popular as a substitute for Wills in Estate Planning. A Revocable Living Trust has several advantages over a Will including avoiding the court process of Probate, avoiding guardianship, maintaining liquidity, and maintaining your family privacy. A Living Trust can be created with a Revocable Living Trust document. This document can be modified at any time. At death, your Estate will not be probated. Debts will be paid and assets distributed by your Successor Trustee according to the instructions in your Trust.
There will be minimal or no court costs associated with administrating your Trust. The Successor Trustee will automatically assume the responsibility of administrating the Trust thereby reducing legal fees associated with court costs, appraisers, legal fees and executor fees.
Upon your death, the Successor Trustee assumes control of the property and can begin making distributions immediately. The Trustee can pay your bills, sell assets and take care of the needs of your beneficiaries without court involvement. Rather than taking months or years, your Estate can be administered in weeks.
A Living Will also provides you flexibility and control. You can change, revoke, amend, or discontinue your Trust at any time. Your assets stay under the control of your Trustee, even if you are incapacitated and after your death. It is often more difficult than a Will to contest.
Finally, Living Trusts are not public. Your family can take care of your financial affairs privately and without the involvement of the court process.
