Checklist Of Things To Do If You Have A Trust

  • Contact surviving family members to inform them of the death and to insure that each of them has a friend available who can share with them the next hours of grief. 
  • Contact a funeral director and known clergy to make an appointment to discuss funeral arrangements.
  • Arrange for care for any family members residing at descendant’s house.
  • Arrange for care for any family pets at descendant’s house.
  • Obtain the descendant’s important papers.
  • Contact our office for a consultation.  The Revocable Living Trust must be registered with the Clerk of Court’s within 30 days after date of death pursuant to C.R.S section 15-16-101(1).  Furthermore, notice of the registration must be given to Trust Beneficiaries within 30 days following registration pursuant to C.R.S. section 15-16-303.
  • Contact descendant’s employer to review employee benefits that may be available.
  • If descendant was receiving Medicare, notify the local office.
  • Contact life insurers and begin processing the descendant’s claim.  Find out what payment options the descendant may have available. 
  • Contact descendant’s Social Security office.
  • If there is a surviving family member; investigate making a claim for survivor’s benefits.  If emergency cash is needed a cash advance may be available from life insurance benefits.
  • If descendant was in the military service, notify the Veteran’s Administration.  Surviving relatives may make claim for death or disability benefits.
  • Obtain a small ledger and keep track of all money that you spend.  This information is needed for tax returns.
  • DO NOT change the title of any assets until after you speak to your accountant and attorney.
  • Obtain safety deposit information and secure the assets. 
  • Secure the descendant’s tangible and personal property for later inventory
  • Confirm that all real and personal property (including the home and motor vehicles) belonging to the descendent are adequately insured in the event of fire, theft, loss or natural disaster.
